The Website is provided to you for your personal use subject to these terms and conditions and any other rules posted on the Website (including our Privacy Policy) (the “Terms and Conditions”).

By visiting the website you agree to be bound by, consent to comply with, and consent to the practices described in, these Terms and Conditions, which govern your access and use of the website and all content and functionalities available on the website (or any of our other websites and related micro-sites accessed through the URL www.miausa.ph and related domain names) (the “Services”).

All references to “we”, “us”, “our”, or “MIA USA-PH” refer to Sienna Sales Marketing Inc. All references to “you”, “your”, or “user” relate to the person or entity who registered an account with this website to use or access the Services.

If you wish to use our Services you must read and agree to be bound by our policies relating to those Services. In particular, your attention is drawn to our policies relating to the terms of purchase and our Privacy Policy. If you are aged under 18, you must let your parent or guardian know about our Privacy Policy before you register to use this website or any of the Services.

2. Privacy Practices

We understand the importance of safeguarding your personal information and we have formulated a Privacy Policy, to ensure that your personal information is sufficiently protected. Apart from these Terms of Use, the Privacy Policy shall also govern your visit and use of the Services. your continued use of the Services implies that you have read and accepted the Privacy Policy and agree to be bound by its terms and conditions. you consent to the use of personal information by MIA USA in accordance with the terms of and purposes set forth in the Privacy Policy, the same may be subject to amendment from time to time at the sole discretion of MIA USA-PH.

This Services is directed to be used by adults only. We assume that any minor, if at all, accessing our Services is under the supervision of their guardians. MIA USA-PH does not knowingly collect information from minors. you will be responsible for maintaining confidentiality of your account, password, and restricting access to your computer, and you hereby accept responsibility for all activities that occur under your account and password. you acknowledge that the information you provide, in any manner whatsoever, are not confidential or proprietary and does not infringe any rights of a third party in whatsoever nature.

If you are accessing, browsing and using the Services on someone else’s behalf; you represent that you have the authority to bind that person to all the terms and conditions herein. In the event that the person refuses to be bound as the principal to the Terms of Use, you agree to accept liability for any harm caused by any wrongful use of the Services resulting from such access or use of the Services in whatsoever nature.

If you know or have reasons to believe that the security of your account has been breached, you should contact us immediately at the ‘Contact Information‘ provided below. If we have found a breach or suspected breach of the security of your account, we may require you to change your password, temporarily or permanently block or suspend your account without any liability to MIA USA-PH.

We reserve the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, in our sole discretion, that it would be in MIA USA-PH’s best interests to do so. you are solely responsible for all contents that you upload, post, email or otherwise transmit via the Services. The information provided to us shall be maintained by us in accordance with our Privacy Policy.

4. Orders

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order and refund you or re-credit your account for any sum that has been paid by you or debited from your credit/debit card for the product(s) which cannot be supplied by us.

The products sold on the website are not for re-sale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.

Once your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, it is a confirmation that we have received it.

Unless cancelled, acceptance of your order will be perfected upon completion of the packing of your order by us. Completion of the contract between you and MIA USA-PH will be perfected when we dispatch the products to you, at which time you will receive a second email confirming that your order has been dispatched.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from the website, whether or not that product has been sold, removing, screening or editing any materials or content on the website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Store Pickup

Items on https://miausa.ph/shop/ are available to buy online and collect in the store. You can choose collect in store by selecting the ‘Store Pickup’ option when placing the order.

you will receive a confirmation email when you place your order. The confirmation email must be present and displayed at the time of collection. you will be charged for the order at the time you pick up your order at the store.

Orders placed before 3:00 P.M. PST will be available for pick up on the next business day. Saturdays, Sundays, and Public Holidays are not considered as business days. Please always check the opening hours.

Orders will be held for 14 days from when placed before being cancelled. After 14 days the store will cancel the order without prior notification.

5. Payment Terms

Payment of the orders shall be coursed through the payment processing services of PayMongo Philippines, Inc (“PayMongo”). Your rights and obligations in using the payment processing service shall be governed by the Terms of Use of PayMongo.

6. Products Liability

By buying products through the Services, you acknowledge and agree that MIA USA-PH carries no product liability save as described in the preceding paragraphs in relation to returning and exchanging the products or refunding/crediting the price paid

7. Services Security

You are prohibited from violating or attempting to violate the security of the Services, including, without limitation:

  1. Accessing data not intended for you or logging onto a server or an account which you are not authorized to access;
  • Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
  • Attempting to interfere with service to any other user, host or network, including, without limitation, via means of submitting a virus to the Services, overloading, “flooding,” “spamming,” “mail bombing” or “crashing;”
  • Sending unsolicited email, including promotions and/or advertising of products or services; or
  • Forging any header or any part of the header information in any email or newsgroup posting. Violations of system or network security may result in civil or criminal liability

8. Delivery Policy

  1. When you check out an item, the item quantity specified in their order will be reserved and deducted from the quantity of the item stock.
  • Your items will be delivered to the named recipient and to the address you provided as inputted in the Services. A person representing to be authorized to be able to receive the goods will be deemed to be duly authorized by you.
  • We or our logistics partners do not guarantee delivery of items that do not comply with terms and conditions of our respective logistics partners or are classified by us or our logistics partners as prohibited or dangerous.
  • you agree that an Item will be considered unacceptable for delivery if it is classified as hazardous, dangerous, prohibited, or restricted by us (based on our sole discretion) or our logistics partners.
  • Products classified as hazardous, dangerous, prohibited, or restricted by us or our logistics partners and therefore deemed unacceptable for delivery will be returned to you at your cost and/or we reserve the right to dispose of the shipment.
  • All orders are levied a mandatory insurance fee. If there are any damages or losses to your delivered goods, provided that the same is confirmed by our investigation and subject to the claims, directly and materially caused by us or our partner courier, we will issue an amount according to our policy and based on the value of the goods reflected in your account.
  • Without prejudice to the terms, if (1) the recipient refuses delivery, or (2) the delivery is deemed to be unacceptable or it has been undervalued, or (3) the recipient cannot be reasonably identified or located after two (2) delivery attempts, we shall return the package to MIAUSA-PH, subject to a Return-To-Shipper (“RTS”) fee as applicable.
  • IN ALL CASES, item deliveries are subject to the terms and conditions of our logistics partners.
  1. We deliver nationwide except for areas that we and our logistics partners classify as Out of Delivery Zones (“ODZ”), which are areas that we or our logistics partners cannot deliver directly to due to safety concerns, poor terrain, limited availability or for any reason that We or our partner courier may have for classifying the area as such.   • ODZs are reviewed on a regular basis and may change without prior notice.
  • Buyers whose delivery address is classified as an ODZ will need to pick up their package at the nearest branch of our logistics partners. You will be contacted in such cases on where you can pick up your package.
  • 9. Service Guarantee Policy

You have access to the guaranteed delivery. Otherwise, if we fail to meet this, we hold ourselves accountable under this policy. Our policy also promotes confidence and trust in you and our Services by implementing mechanisms that assure that you will not be defrauded and that transactions made on the Services are safe. Under certain circumstances, pursuant to this policy, we may grant you rebates.

  1. Seller Rebates for Late Deliveries
  1. Rebate is applied if the first delivery attempt on a delivery order is made beyond the committed delivery date.
  • Rebate does not apply if a system-wide advisory on delays is sent out via social media channels, website, in-app notifications, email, and/or SMS. This system-wide advisory shall be considered prior notice to you.
  • The amount representing the rebate you are entitled to will be deposited directly to your nominated bank account.
  • Rebate does not apply if you have violated any of our terms and conditions.
  • Money Back Guarantee
  1. You must file a “hold payment request” via customer service email within two (2) days from delivery.
  • If we receive a “hold payment request” via email, we will put your payment on-hold due to your complaint at 12PM the following day.
  • We will resolve the dispute with you within seven (7) business days, otherwise, the payment will be returned to you.
  • We will consider a dispute resolved only if you provide us with supplementary documents to support the agreed resolution. This includes:
  1. Message trail between two parties.
  2. Valid IDs such as but not limited to Driver’s License, BIR ID, GSIS ID, and Passport, or any valid government ID.
  3. Three specimens of signature.
  • If you voluntarily decide to replace the order, your payment will be cancelled and you will need to book a new transaction in our Service.
  • If you do not update us within seven (7) days from the receipt of the dispute message from us, we will refund the you and close the case. No further claim can be made against us.
  • In the event a refund is warranted where only the item price will be refunded back to you, shipping and insurance fees and other service fees will not be refunded.
